Wills and Estates

Where there’s a Will – everyone will want to be in it.

Before you shuffle off at the end of a life well lived, we’ll help ensure your valuables will go to the right people, and your wishes will be followed to the letter. And that your funeral playlist will be the perfect soundtrack to your send-off.

1. What are Wills & Estates?

Once you die, everything you own and everything you owe is known collectively as your ‘estate’. Creating a Will sets out your wishes for your estate, and provides instructions about what will happen to you and your belongings. So, if giving Cousin Jerry your souvenir teaspoon collection is a must (even if it’s out of spite), so is writing your Will.

2. How Marks & Worth Lawyers can help.

Though you choose what goes in it, your Will does need to comply with the law. Getting a Will drafted by someone with experience means all the proper procedures are followed, and you’ve included the important stuff... from Betty, your ‘78 Ford Bronco, to your children.

We have a straightforward process to create your own Will. No waiting, no traveling, no unnecessary appointments, or time restrictions. We’re also highly experienced in administering estates after loved ones pass away, and can provide support and advice to help resolve family disputes related to wills and estates.

We offer compassionate legal support with Wills & Estates, so you can:

- Provide best and most fairly for loved ones

- Sleep better, knowing your Will is correctly drawn up and valid

- Consider all the details, (including who can challenge your will and on what grounds)

- Appoint the right executor – and know which extra powers available to executors and trustees you might want to include in your will

- Form Trusts for your beneficiaries

If you’re willing, we’re able. Talk to us about creating a watertight Will today.

FAQ

Think of this as a Community Chest of knowledge if you will

Wills can cover anything from what happens to your belongings, donating your body to science, who looks after your children or who inherits your chewing gum wrapper collection. Our job is to make this process simple for you, ensure you haven't missed any vital information and that your final wishes are recorded.

You don't need to wait until you are a millionaire, have purchased an enormous parcel of land, or have family members leaving post-its on the bottom of your things. Planning your Will can be done at any point in your life and, most importantly, should be changed and updated as your life, assets and family do.

If you have an asset (for example Kiwisaver) worth more than $15,000, then you need a Will.

Just because you live in a one-bedroom apartment with your dog Russell doesn't mean a Will is less valuable or important. Everybody should have a Will because who would look after Russell if something happened to you? And, if kids are in your future, you can update your Will anytime to include them.

Of course! Nothing is set in stone until you pass away, so if you want to add, remove or cancel your Will, you can let us know anytime. There is still a formal process to update or cancel your Will, and we can advise you on that.

Who has got the power? Well, that's up to you. Choosing an executor means choosing someone you trust to uphold the contents of your Will as efficiently and smoothly as possible. If you're unsure who to choose, you can talk through your options with us, and we can help you bestow that power.

A villa in Spain? A pub in Ireland? Maybe a UK pension? Depending on where in the world your assets are and what they are, your New Zealand Will may be able to deal with this. However, it's best to chat with us about your specific situation and if a Will in another country is right for you.
